1. INFORMATION COLLECTION: PERSONALLY IDENTIFIABLE INFORMATION
a. In the course of using the ODC Services, we may ask you to provide us or you may otherwise have the ability to provide us with, certain personally identifiable information (i.e., information that can be used to uniquely identify you personally) (“Personally Identifiable Information”). Personally Identifiable Information may include, but is not limited to, your name, phone number, credit card or other billing information, email address, device geolocation information, and home and business postal addresses.
b. Please be aware that when you register to become an ODC member, other users of the ODC Services may be able to see your screen or user name, in addition to any comments or submissions that you post to the Sites or submit via the ODC Services. We recommend that you guard your anonymity and sensitive information and that you not use your real name as your screen or user name to the extent that allows others to identify you.
c. If you access the ODC Services via a third-party platform or service account (e.g., by logging in to the ODC Services using your Facebook account credentials) and/or integrate your ODC account with your third-party platform account, we may collect certain information from such third-party platform, such as your username and other information you provided to such platform in connection with your account (e.g., name, country, date of birth, gender and e-mail address).
d. As you use the ODC Services, our servers automatically record information that the browser sends whenever it points to a website or online service (“Log Data”). Log Data may include, but is not limited to, your computer’s Internet Protocol address, browser type, the web page you were visiting before you came to one of the Sites and information you search for on a Site. When a user downloads the ODC Player, we may record that a download took place. When you launch the ODC Player on a website our servers may automatically record Log Data. When the ODC Player checks for new updates, it may also automatically send version number and operating system information to our servers.
e. Like many websites, we use “cookies” to collect information. A cookie is a small data file that we transfer to your computer’s hard disk for record-keeping purposes. We use “persistent cookies” to save your username and login password for future logins to the Sites. We use “session ID cookies” to enable certain features of the ODC Services, to better understand how you interact with the ODC Services and to monitor web traffic routing on the Sites and aggregate usage of the ODC Services. You can instruct your browser, by changing its options, to stop accepting cookies or to prompt you before accepting a cookie from the websites you visit. If you do not accept cookies, however, you may not be able to use all portions of the Sites or all functionality of the ODC Services.
g. We and our service providers may also use other technologies that are similar to cookies, such as browser storage and plugins and web beacons (also known as clear gifs or pixel tags). Like cookies, some of these technologies may store small amounts of data on your device. We may use these and various other technologies for similar purposes as cookies, such as to enforce our terms, prevent fraud, and analyze the use of the ODC Service. There are various ways to exercise choice regarding these technologies. For example, many popular browsers provide the ability to clear browser storage, commonly in the settings or preferences area; see your browser’s help function or support area to learn more.
2. OUR POLICY TOWARD CHILDREN
www.ondemandchina.com is not a website directed to children and ODC does not knowingly collect personally identifiable information from children under 13. If a parent or guardian becomes aware that his or her child has provided us with Personally Identifiable Information without their consent, he or she should contact us at firstname.lastname@example.org. If we become aware that a child under 13 has provided us with Personal Information, we will delete such information from our files.
3. HOW WE USE PERSONALLY IDENTIFIABLE INFORMATION
a. “Non-Personally Identifiable Information” is information that cannot be used to uniquely identify you personally. Some examples of Non-Personally Identifiable Information include your IP address, the type of browser software you use when visiting our site, the date and time you visit our site and what pages you viewed when visiting our site.
b. We may use your Personally Identifiable Information for the following purposes: (i) to provide and improve the ODC Services, features and content, (ii) to administer your use of the ODC Services and your ODC account, (iii) to enable users to enjoy and easily navigate the Sites, (iv) to better understand your needs and interests, (v) to fulfill requests you may make, (vi) to personalize your experience, (vii) to provide service announcements, and (viii) to provide you with further information and offers from us or third parties that we believe you may find useful or interesting, including newsletters, marketing or promotional materials and other information on ODC related services.
c. If you decide at any time that you no longer wish to receive such marketing or promotional communications, please follow the unsubscribe instructions provided in any of the communications. If you are a registered user of the ODC Services, you may also opt-out of receiving such communications by adjusting your preferences in your account. Please note that we may still send you emails regarding changes to our policies or in connection with a purchase via the ODC Services or other purposes specifically relating to your account and/or use of the ODC Services.
e. By registering with ODC, you consent to receiving periodic notifications including: ODC updates and newsletters, relevant account notifications, ODC group/buddy invitations, order/download confirmations and private message notifications. In addition to these you may opt-in to notifications including: media subscriptions and group updates. We will provide means to opt-out of any marketing or promotional email notifications from ODC and will include links to opt-out in such emails.
4. INFORMATION SHARING AND DISCLOSURE
a. Third Parties. We will not share or sell your Personally Identifiable Information with other organizations for their marketing or promotional uses without your express consent.
b. Subscriber Members Sharing: In addition to your username, any comments or submissions that you post to the ODC Services will be publicly available. Any information you choose to provide in a comment or a submission should reflect how much you want other users to know about you. We recommend that you guard your anonymity and sensitive information and we encourage ODC members to think carefully about what information about themselves they disclose in their comments or submissions.
c. Aggregate Information and Non-Identifying Information. We may share Non-Personally Identifiable Information and Log Data with third parties for industry analysis, demographic profiling, and to deliver targeted advertising about other products and services. Any aggregated information shared in these contexts will not contain your Personally Identifiable Information.
d. Service Providers. We may employ third party companies and individuals to facilitate the ODC Services, to provide the ODC Services on our behalf, to perform services related to administration of the ODC Services (including, without limitation, bill and credit card payment processing, maintenance, hosting and database management services, web analytics and administration). These third parties have access to your Personally Identifiable Information only to perform these tasks on our behalf and are obligated not to disclose or use it for any other purpose.
e. Compliance with Laws and Law Enforcement. ODC cooperates with government and law enforcement officials and private parties to enforce and comply with the law. We will disclose any information about you to government or law enforcement officials or private parties as we, in our sole discretion, believe necessary or appropriate to respond to claims and legal process (including but not limited to subpoenas), to protect the property and rights of ODC or a third party, to protect the safety of the public or any person, or to prevent or stop any activity we may consider to be, or to pose a risk of being, illegal, unethical, inappropriate or legally actionable.
f. Business Transfers. ODC may sell, transfer or otherwise share some or all of its assets, including your Personally Identifiable Information, in connection with a merger, acquisition, reorganization or sale of assets or in the event of bankruptcy or similar insolvency event.
g. Group Entities. We may disclose your Personally Identifiable Information to other group entities that are affiliates and/or subsidiaries or parents of ODC Media, Inc. in order to provide you with tailored products, services and communications or in accordance with our internal policies or administrative or business practices.
5. USER CHOICE REGARDING COOKIES AND ADVERTISING IDENTIFIERS
The ODC Services and our third party advertising service providers may employ cookies and other tracking technologies to gather information regarding your use of the ODC Services, your web browsing activity and your device, such as your IP address, device type and other identifiers, browser type, web pages visited, non-precise location information, and information about your interaction with advertisements. This information is collected in an anonymized, de-identified format and does not personally identify you. Your information relating to your use of the ODC Services may be combined with information relating to your other online activities over time and across different websites (including those operated by third parties) and devices. The information collected or received by our third party advertising service providers may be used to show you targeted advertisements for products and services that you might be interested in, on the ODC Services and on third party websites and services. This information may also be used to prevent you from seeing the same advertisements too many times and to conduct research regarding the usefulness of certain advertisements to you. 6. CHANGING OR DELETING YOUR INFORMATION
ODC is concerned with safeguarding your information. We employ a variety of industry-standard measures designed to protect your information from unauthorized access. These measures are designed to provide a level of security appropriate to the risks of processing your personal information. Unfortunately, no measures can be guaranteed to provide 100% security. Accordingly, we cannot guarantee the security of your personal information.

We do not exercise control over third party websites.
